Data Protection Registration for landlords by end of February 2021
REQUIREMENT BY LAW FOR LANDLORDS TO REGISTER WITH ODPA BETWEEN 1ST JANUARY & 28TH FEBRUARY 2021 AND ANNUALLY THEREAFTER
Members of GPRLA Council have requested ODPA to extend the period of registration beyond 28th February in reaction to the new Covid-19 lockdown in Guernsey. We have had in response from ODPA the quoted legislation ‘time frame’ only, plus advised it is in ‘discussions with government’.
Further, ODPA would not confirm whether or not it is possible to make a late registration and pay the fee after 28th February 2021. This means once the 28th February 2021 has passed, perhaps registration/payment can’t be done again till Jan/Feb 2022. There is no published scale of fees/fines for late registration/fee payment.
In response to questions to the Committee for Home Affairs they say there is currently no flexibility to extend this date. However they say they can, following consultation with the ODPA and the authorities of Alderney and Sark, amend the relevant Data Protection Regulations which establish the fee process. The Committee acknowledges the pressures on many businesses at this time and has agreed, without commitment, to conduct a review of the fee process within the coming year. They say the concerns that we have raised will contribute to that review. Obviously this does not help us now.
The ODPA website still includes at the start the number of days left in which to register (9 today), an explanation of the registration process, and who is required to register. So we ask you to please visit www.odpa.gg to view this. Then if you hold details of your tenants as individual/s, please comply with the law and register by the end of February if you haven’t already done so.
